1. Acceptance of Terms

By accessing and using the website www.oenergy.cl (hereinafter, the “Website”), you (the “User/s”) acknowledge you have read, understood, and agreed to the terms of use (“Terms of Use”) specified below. These Terms of Use govern the entire relationship that Users have with the oEnergy group (hereinafter “oEnergy”), constituting a legally binding contract between the parties.

2. Intellectual Property

The entire content of the Website and each of the different elements included in it, such as texts, images, logos, graphics, videos, software, and designs are protected by intellectual property laws. For such purposes, it shall be understood as part of the Website all those creations incorporated and expressed by any means and/or tangible or intangible support, known or to be known, which are subject to protection by the legal provisions in force regarding intellectual property. The ownership of these rights belongs to oEnergy Generación Solar Distribuida SpA and/or any related company of the oEnergy group to which its rights have been assigned. Any unauthorized reproduction, distribution, modification, or use of these materials is strictly prohibited without prior written consent of oEnergy.

The Website is intended for personal and non-commercial use only. Users may access and view all the information, as well as print and partially download the content only and exclusively for their personal and private use.

Consequently, by accessing the Website, the User agrees to the following:

a) To use correctly the information and contents of the Website, under their exclusive responsibility, respecting the present Terms of Use, as well as the legislation in force, and good morals and public order at all times. Therefore, the User will not be able to use the Website with illicit aims or that attempt against the rights or interests of third parties, nor of oEnergy. The User will not carry out conducts that cause or can cause the collapse, fall, uselessness, damage, or loss, total or partial, of the Website.

b) The contents, trademarks, patents, copyrights, trade and/or industrial secrets and, in general, the intellectual property of the Website are the exclusive property of oEnergy. Thus, it is prohibited to reproduce, copy, reverse engineer, commercialize, publish, or modify the contents of the Website, the trademarks, or other distinctive signs, patents of invention or any other intellectual property belonging to oEnergy unless prior written authorization has been obtained from oEnergy. Furthermore, the User is prohibited from appearing before third parties using oEnergy’s trademarks or trade names.

c) It is prohibited to establish hyperlinks or links between the User’s own webpage or application and the Website unless oEnergy has expressly given written authorization.

d) The User shall be liable for any damage and/or harm of any nature that oEnergy may suffer as a result of the breach of any of the obligations set forth in these Terms of Use. As a consequence, if oEnergy is obliged to compensate any damage or harm as a result of the misuse of the Website by the User, the non-compliant User shall be obliged to reimburse such an amount or compensate oEnergy, as the case may be.

e) To guarantee that all the information voluntarily provided by the User on the Website is true, accurate, and current and that the User agrees to keep it updated.

This Website may contain links or hyperlinks to third-party websites. These links are provided solely as a convenience to you, and oEnergy has no control over the content or the privacy policies and terms and conditions of these sites.

Accordingly, oEnergy will try its best to verify that the Internet sites to which Users are redirected are safe and that this information is accurate. Notwithstanding the foregoing, oEnergy assumes no responsibility for the content of these websites or for any consequences that may arise from their use, except for gross negligence on the part of oEnergy. oEnergy will not be liable for any damages or adverse consequences suffered by Users as a result of their visit to the Website, nor for any actions or decisions taken by Users based on the information contained therein, unless such action or decisions are due to oEnergy’s gross negligence.

7. Applicable Law and Jurisdiction

These Terms of Use shall be governed and construed in accordance with the laws of the Republic of Chile.

By visiting the Website, the User submits to the jurisdiction of the courts of the Republic of Chile to resolve any doubt, difficulty, or controversy related in whole or in part to these Terms of Use. For all legal effects derived from this instrument, the parties establish their domiciles in the city and district of Santiago.
